A CHARTER ORDINANCE EXEMPTING THE CITY OF UDALL, KANSAS, FROM THE PROVISIONS OF K.S.A. 12-1222, AND ALLOWING THE MAYOR TO APPOINT TRUSTEES OUTSIDE THE MUNICIPALITY.

WHEREAS, the Udall City Library is having difficulty finding seven citizens willing to sit on the library board, the library board, hereby, passed the following resolution:

       The Udall Public Library Board of Directors has had problems finding suitable board members to fill the 7 positions required by the State of Kansas for public libraries. This is almost impossible in our small rural area.

       The Udall Public Library Board of Directors hereby request the governing body of the Udall City Council to adopt a City Charter Ordinance to allow an extension of the boundaries outside of the city limits of Udall, Kansas for two board of director members. The boundaries outside of the city limits would include within the school district of USD 463 but limited to the following boundaries: West of the Udall City limits to N. River Road, North of the Udall City limits to 2nd Road, East of the Udall City limits to 61st Road and South of the Udall City limits to 122nd Road. The use of the boundaries within the school district is a better fit for those patrons who will use the Udall Public Library and be willing to serve as board members.

       Adopted by the Udall Public Library Board of Directors on April 30, 2018.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF UDALL:

Section 1. The City of Udall, Kansas, by virtue of the power vested in it by Article 12, Section 5 of the Constitution of the Stat of Kansas hereby elects to and does exempt itself and make inapplicable to K.S.A. 12-1222 which applies to this city but does not apply uniformly to all cities.

Section 2. All officers elected or appointed shall be residents of the municipality, except the city may appoint as members of the library board a maximum of 2 residents from outside the city, but within the school district of USD 463, but limited to the following boundaries within Cowley County, Kansas: West of the Udall City limits to N. River Road, North of the Udall City limits to 2nd Road, East of the Udall City limits to 61st Road and South of the Udall City limits to 122nd Road.
